South Tours is a registered travel agency operating under KJB South Tour Co., Ltd, located at Patong Beach, Phuket, Thailand. We have been operating since 1989. South Tours acts as an authorized booking agent connecting customers with independent tour operators. We do not directly operate tours, transportation, or accommodation services.

2. Acceptance of Terms

By completing a booking through southtours.com, you confirm that you have read, understood, and agreed to these Terms & Conditions in full. These terms constitute a binding agreement between you and KJB South Tour Co., Ltd.

3. Bookings & Confirmation

All bookings must be made at least 7 days in advance of the tour departure date. Bookings made within 7 days of departure are handled directly via WhatsApp and are subject to availability.

A booking is confirmed only upon receipt of full payment. Upon successful payment, an automated booking confirmation will be sent immediately to your email address, including your booking reference, tour details, date, and total amount paid.

A member of our team will contact you by email or WhatsApp within 24 hours to confirm your exact pickup time and any additional details relevant to your tour.

4. Pricing

All prices are displayed in Thai Baht (THB) and are per person. Prices include hotel transfer from standard areas (Patong Beach, Karon Beach, Kata Beach, and Kamala) unless otherwise stated. Customers located outside standard transfer areas may be subject to additional transfer charges, which will be communicated prior to confirmation.

Infant pricing: children under 4 years of age travel free of charge. Child pricing applies to children aged 4 to 11 years (or as specified per tour). Adult pricing applies to all passengers aged 12 and above. Note: for safety reasons, infants under 2 years of age are not accepted on speedboat tours (Phi Phi Islands, James Bond Island, Similan Islands, Krabi Highlights, Raya & Coral Islands).

South Tours reserves the right to correct pricing errors. If a pricing error is identified after booking, we will contact you immediately and offer either the correct price or a full refund.

5. Payment

Payments are processed securely via Stripe. South Tours does not store payment card details. By completing payment, you authorize the charge to your nominated payment method. All transactions are subject to Stripe's terms of service.

7. Health, Fitness & Restrictions

Certain tours are not suitable for customers with specific health conditions, physical limitations, or age restrictions. It is the customer's responsibility to review the tour restrictions listed on each tour page before booking. By completing a booking, you confirm that all members of your party meet the health and fitness requirements of the selected tour.

Customers who are pregnant, wheelchair bound, have mobility difficulties, back injuries, heart conditions, or any other relevant pre-existing medical condition are required to inform South Tours at the time of booking. Participation may be subject to the operator's approval. Depending on the specific circumstances, the operator may require a signed waiver prior to participation.

For speedboat and speed catamaran tours, passengers must be between 1 and 70 years of age. Pregnant women are not permitted on speedboat tours under any circumstances.

South Tours and its operators reserve the right to refuse participation to any customer who does not meet the tour requirements, at the time of pickup or at the departure point, without refund. Children must be accompanied by a responsible adult at all times during the tour.

8. Third-Party Operators

Tours are operated by independent third-party providers. South Tours is not responsible for the acts, omissions, or negligence of tour operators, their staff, or subcontractors. All operators are selected for their professionalism and carry their own insurance and liability coverage. Tour itineraries, schedules, and inclusions are subject to change at the operator's discretion, including for safety, weather, or operational reasons.

9. Weather & Force Majeure

Tours may be cancelled or modified due to adverse weather conditions, natural events, government directives, or other circumstances beyond our control. South Tours accepts no liability for costs incurred as a result of force majeure events, including but not limited to flights, accommodation, or personal expenses.

10. Minimum Passenger Requirements

Some tours are subject to minimum passenger numbers set by the operator. In the event that a tour is cancelled by the operator due to insufficient bookings, a full 100% refund will be issued to affected customers.

11. Personal Belongings & Valuables

South Tours and its operators accept no responsibility for loss, theft, or damage to personal belongings or valuables during any tour. Customers are advised to travel with appropriate personal travel insurance.

12. Behavior & Conduct

Customers are expected to behave respectfully toward tour staff, guides, other passengers, local communities, and wildlife. South Tours and its operators reserve the right to remove any customer whose behavior is deemed disruptive, dangerous, or offensive, without refund.

13. Governing Law

These Terms & Conditions are governed by the laws of the Kingdom of Thailand. Any disputes arising from bookings made through southtours.com shall be subject to the exclusive jurisdiction of the courts of Phuket, Thailand.

For bookings where transfer pricing requires confirmation by our staff after booking (unusual hotel locations, private residences, or specific tour restrictions), a South Tours representative will contact you within 24 hours. If the confirmed transfer price is not acceptable to the customer, a full 100% refund will be issued — no questions asked.

4. How Refunds Are Processed

All refund requests must be submitted via WhatsApp to our team at +66 88 766 0827. Approved refunds are processed through Stripe and returned to the original payment method within 5–10 business days. The 10% processing fee is deducted from the refunded amount where applicable.

5. Date Changes

Customers wishing to change their tour date must contact us at least 72 hours before the original departure. Date changes are subject to availability and must be requested via WhatsApp. No fee is charged for a single date change made within the cancellation window.

South Tours acts as an authorized booking agent for independent tour operators. All tours are operated by third-party providers who carry their own insurance and liability coverage. South Tours is not liable for incidents, injuries, or losses occurring during tours. Customers are encouraged to arrange personal travel insurance prior to departure.

We process your personal data on the basis of contractual necessity — your data is required to fulfill the booking you have requested. By completing a booking, you provide your consent to the processing of your personal data as described in this policy.

Your personal data may be shared with independent tour operators (to arrange your tour and transfer) and Stripe Inc. (to process your payment securely). We do not sell, rent, or trade your personal data to any third party for any commercial purpose.

6. Data Retention

We retain your personal data for a period of 3 years following your tour date, for accounting, legal, and customer service purposes. After this period, your data is securely deleted.

Under the Personal Data Protection Act of Thailand, you have the right to: access your personal data, correct inaccurate data, request deletion of your data, withdraw consent at any time, and lodge a complaint with the Personal Data Protection Committee of Thailand. If you click Accept on the cookie banner, we also load Google Analytics 4 (GA4) to understand anonymous site usage (pages visited, device type, approximate location).
